पार्टी के बजाय प्रत्याशी को चुनाव चिह्न आवंटित करने की मांग, याचिकाकर्ता पर 25 हजार का जुर्माना

नई दिल्ली (New Delhi), . राजनीतिक पार्टियों को चुनाव चिह्न आवंटित किए जाने को गलत बताने वाली याचिका सुप्रीम कोर्ट (Supreme court) ने खारिज कर दी. जस्टिस संजय किशन कौल की अध्यक्षता वाली बेंच ने कोर्ट का समय बर्बाद करने के लिए याचिकाकर्ता पर 25 हजार रुपये का जुर्माना भी लगाया है.
यह याचिका वकील श्रद्धा त्रिपाठी ने दायर की थी. याचिकाकर्ता का कहना था कि चुनाव चिह्न पार्टी नहीं, प्रत्याशी को दिया जाना चाहिए. चुनाव चिह्न चुनाव लड़ने वाले उम्मीदवारों को आवंटित किए जाते हैं न कि राजनीतिक दलों को. कानून के तहत चुनाव आयोग के पास आवंटन की शक्ति नहीं है. आवंटन की शक्ति रिटर्निंग अफसर के पास रहती है.

इस पर कोर्ट ने कहा कि इस याचिका के जरिये पूरी तरह से प्रावधानों को गुमराह करने की कोशिश की जा रही है और वास्तव में चुनाव प्रक्रिया को बाधित किया जा रहा है. हमें लगता है कि यह न्यायिक समय की पूरी बर्बादी है.
